I lodged an application for a rescission of my debt review in Oct 2018 and received a court date for my case to be heard in Feb 2019. When my attorneys arrived at court they were informed that the court had lost my case file.

They had then asked whether they could open a duplicate file and ask the Magistrate to hear the matter. The Magistrate however declined to hear the matter as he was of the opinion that he needs the court file notes in order to make his decision.

My attorneys have subsequently informed me that they have taken the court on review, with another agonising wait on the cards for myself.

I’d like to know if there is any other course of action I could persue. Could I contact teh court directly, in the case that my attorneys are possibly giving me the run-around afetr I’ve already paid the associated fees.

My life is now on hold after I’ve invested a few years in rehabiltion of my credit status and urgently need to move on with my life. I lodged the rescission as I will shortly have to relocate and won’t be able to enter into a bond agreement with this hanging over me. My life is literally at a stand still 9 months after stating the process.

Hi there, i am a young lady who has found herself in a financial difficulty after my first employment. Because i was working for the first time after my studies i landed in alot of debt. Opening this and that accounts and ended up over indebted. i took the initaitive to apply for Debt review because at time i thought it was the best option for me. i was under Debt care for almost a year and i decided to stop payments because they did not render the service that they promised in the beginning of my application. I havent paid my accounts since then and i would like to start paying my creditors myself from now on. i wanted to find out how i can cancel the debt review under my name and start paying all my loans off. i have had an increase at work and i feel i am able to continue paying my account. Is it possible if a civil court may give me such a clearance? and what is the procedure?

I am in the process of launching a start-up which facilititates equity crowdfunding in South Africa. However, given the infancy of the initiative in South Africa, there is not much regulatory legislation surrounding the subject at all. Nor is there any relevant case law. According to what I have read, in order to offer securities to the public, the company would have to be public. However, as a start-up, it is not feasible to make that transition just yet. Abiding by the existing legislation (Companies Act etc.) is obviously paramount, but given the premature nature of my potential company and the fact that existing legislation does not specificy provisions for crowdfunding, I find myself in a bind as I struggle to determine the most appropriate way forward. Please let me know what my options are, and if there is a chance that I may be able to offer securities as a privately-owned company.
