My son and I jointly own a property which has a granny flat in the yard. 

We took in a tennant on a short term (3 months) basis and have a contract to that effect. The reason we went for a short temr lease was that we did not know if having a tennant would work with the layout of the property. The lease period was from 1 January to 31 March 2019.

Due to a lot of problems we have had with the tenant, and the fact that the layout of the property does not really lend itself to this living arrangement, we notified the tenant in writing on the 2nd February, that we would not be renewing the contract after 31 March.

The tenant has not paid rent for February and says she does not intend to. She also claims the lease period was for a year and does not intend to move out by 31 March.

I know that we can apply for an eviction order, but that can be dragged out for months or years and in the meantime she is squatting on our property.

I want to know if there is any legal reason why I cannot move into the flat myself on 1 April. I will not kick her out – just simply move in with her.

The way I am reasoning is:

1. I am the owner of the property

2. She does not have a valid lease agreement after 31 March

3. She has not paid her rent for February

4. She will not like living with me 

So what legally prevents me from moving in there.

Kindly assist with the following query.

I rent a cottage on the same property as another house, the main house, and we share a cash power box. My contract states that I have to include a receipt for R 500 electricity with every rental payment, which I have done since I moved in. Today I contacted the estate agents in charge of my contract to inform the landlord that the box is running low and to please add more electricity. I was told to make a plan as the tenants for the main house will only be back in October.

Now I have already added my monthly electricity, used up by the main house tenants who were here this weekend, and as a single mother I do not have the additional funds to add more. I will of course make a plan not to sit in the dark over a very cold front, however what are my rights to avoid this dilemma in future? Surely the landlord is in breach of contract? Would it be in order to deduct whatever I have to add from my next rental payment?

I recently moved to South Africa so I am not familiar with the law regarding lease agreements. I signed a lease agreement two weeks ago that I want to cancel now, which is 35 days before the beginning of the rental period. The landlord says that I will have to pay the rents until she find a suitable tenant, is that legal ? Will I be legally obligated to pay until the end of the lease, which is for 6 months, if she cannot find another tenant?

Hi I have a property in Gauteng, but live KZN. I have had 3 tenants not paying and have moneys owing from them and need to get it collected but don’t know how to get the moneys from them, what can I do and how and where?

I also have the last tenants whom the agent has the depoit and has not paid the deposit and the tenant also has an outstanding amount owing on the rental and utilities, it has now gone over 18 days since they moved out because their lease was finished and I refused to renew. what is my recourse and how do I get my money from both?
