I was employed by Finsch Mine as an artisan carpenter. In 2007 the Mine outsourced this function to me and I started a company. We are doing infrastructure maintenance and revamping for the Mine. In 2011 the mine was sold as a “going concern” to Petra Diamonds and we were kept on with the same conditions and arrangements. For the past 12 years our contract were renewed bi-annually. They now have advertised a tender for this function. Petra has also moved away from the “close tender” system and we had to register on their website (eProcure Portal) as a vendor. Are we covered under section 197 of LRA? And what are our rights/options in this regard? Because we are not gauranteed of a contract anymore?
